Senator Marshall Reintroduces End Taxpayer Funding of Gender Experimentation Act
Washington –U.S. Senator Roger Marshall, M.D. (R-Kansas) today reintroduced the End Taxpayer Funding of Gender Experimentation Act. This legislation prohibits the use of federal funding for gender transition procedures and bars federal healthcare facilities, physicians, and providers from providing such procedures.
If signed into law, the End Taxpayer Funding of Gender Experimentation Act would be a step toward codifying President Donald Trump’s executive order specifying that it is the policy of the United States that it will not fund the “so-called transition” of an individual from one sex to another.
“After years of radical gender ideology under the Biden Administration, it’s time for a return to common sense,” Senator Marshall said. “Americans have spoken loud and clear – they do not want their hard-earned taxpayer dollars paying for gender transition procedures. Sixty percent of Americans say sex is assigned at birth, and seventy-two percent of Americans think it should be illegal for doctors to perform gender transition procedures on minors. By prohibiting the use of federal funds for gender transition procedures, this bill restores the dignity of men and women across the country and delivers another major win for the American people.”
Representative Doug LaMalfa (R-California-01) will join Senator Marshall inintroducing the House companion of this legislation in the U.S. House of Representatives.
“Taxpayers should never be forced to fund gender reassignment surgeries and treatments. The End Taxpayer Funding of Gender Experimentation Act puts an end to the misuse of federal dollars on these controversial procedures, protecting taxpayers from being complicit in this radical agenda,” said Rep. LaMalfa. “I thank Senator Marshall for standing with me to ensure that taxpayer money is used for real healthcare priorities, not for funding gender experimentation.”
This bill is co-sponsored by Senators Jim Risch (R-Idaho), Lindsey Graham (R-South Carolina), Kevin Cramer (R-North Dakota), Tim Sheehy (R-Montana), Cynthia Lummis (R-Wyoming), Mike Lee (R-Utah), Ted Budd (R-North Carolina), Josh Hawley (R-Missouri), Marsha Blackburn (R-Tennessee), Roger Wicker (R-Mississippi), Jim Banks (R-Indiana), and Cindy Hyde-Smith (R-Mississippi).
“Boys are boys, girls are girls, and hardworking Americans shouldn’t be forced to subsidize taxpayer-funded child mutilation and gender transition procedures – that’s common sense,” said Senator Sheehy. “I’m proud to be working to deliver on the mandate the American people gave us to protect our kids, protect taxpayers’ hard-earned dollars, and restore common sense in America.”
“It is difficult to imagine a more commonsense bill. In January, the president quickly stopped taxpayer dollars from contributing to child gender transition operations,” said Senator Wicker. “This legislation would make his changes permanent – forever keeping the federal government out of a practice it never should have endorsed.”
“It is an immutable scientific fact that humanity has two sexes—male and female, man and woman—which cannot be changed through drugs, surgery, or social pretense,” said Senator Lee. “Using the tax dollars of hardworking American families to deny this objective and eternal truth, while attacking the biological and philosophical basis of the family and the human person, is deeply misguided and should never be allowed to happen again.”
“The American people have made it clear that they don’t want their hard-earned tax dollars funding radical gender transition procedures,” said Senator Lummis. “I’m proud to work with Senator Marshall to codify President Trump’s executive order banning federal funds from supporting these types of procedures, especially on our minors.”
“Idaho taxpayers should not be forced to support radical medical procedures that can cause severe damage to our children and teens,” said Senator Risch. “The End Taxpayer Funding of Gender Experimentation Act is commonsense legislation to protect our young people from these harmful procedures and extreme gender ideology.”
“Taxpayer dollars should not be used for invasive and irreversible gender transition procedures, especially those performed on minors who are too young to make such life-altering decisions,” said Senator Hyde-Smith. “Many of these procedures come with long-term health risks and should not be normalized, let alone funded by taxpayers. I’m proud to again support this legislation with Senator Marshall and will continue to advocate for the protection of both our children’s well-being and our tax dollars.”

“For too long, so-called gender clinics have made big money off mutilating children through irreversible surgeries that often leave them sterilized for life. Missouri has banned this practice for minors, and now I’m proud to see similar momentum growing at the federal level,” said Senator Hawley. “Ending taxpayer funding for these barbaric procedures is a crucial step toward protecting Americans from radical gender ideology and delivering on President Trump’s promise to defund the chemical and surgical mutilation of children.”“The Biden-Harris administration launched a dangerous assault on common sense, federally promoting harmful gender transition procedures on the taxpayers’ dime,” said Senator Blackburn. “America has spoken, and the End Taxpayer Funding of Gender Experimentation Act would provide an overdue return to common sense by prohibiting the use of federal funds for gender transition procedures.”
The End Taxpayer Funding of Gender Experimentation Act is supported by Family Research Council and Alliance Defending Freedom.

BACKGROUND:
- Senator Marshall previously introduced the End Taxpayer Funding of Gender Experimentation Act during the 117th Congress and 118th Congress.
- From 2016 to 2021, the U.S. Department of Defense spent approximately $15 million on gender transition procedures for only 1,892 service members.
- Twenty-five states and D.C. have Medicaid policies that explicitly cover transgender-related health care.
- Over 276,000 of the 1.3 million transgender adults are enrolled in Medicaid.
- The bill’s restrictions regarding the use of federal funds do not apply to treatment of individuals with medically verifiable disorders of sex development, such as individuals born with atypical development of chromosomal, gonadal, or anatomical sex.
